Terms of service

These Terms of Service govern your use of customifytee.com and any purchase you make from it. The site is operated by ELSEN FULFILLMENT LLC, a limited liability company registered in the State of Montana, United States, trading as Customify Tee. In these terms, "we", "us" and "our" mean ELSEN FULFILLMENT LLC; "you" means the person using the site or placing an order.
By placing an order you agree to these terms. Please read them before you buy.
1. Who can order
You must be at least 18 years old and able to enter a binding contract under the laws of your state. Everything we sell is adult apparel, drinkware or wall art — we do not sell children’s or youth-sized products. If you are under 18, ask a parent or guardian to place the order.
We ship to addresses in the 50 United States and the District of Columbia only.
2. Products and how they are described
Every item is printed to order. We publish measured chest and body dimensions for each size and describe materials as accurately as we can. Two caveats apply to all printed apparel and are not defects:
- Color on screen. Displays are calibrated differently and no two show a color identically. The item you receive may differ slightly in shade from what you see on your monitor or phone.
- Print placement tolerance. Direct-to-garment printing has a normal placement tolerance of roughly half an inch. A print that sits within that tolerance is correctly made. A print that is visibly crooked, cut off, or misaligned is a defect and is covered by our Refund & Returns Policy.
3. Pricing and pricing errors
All prices are in U.S. dollars and exclude shipping unless your order qualifies for free shipping. Any sales tax we are required to collect is calculated at checkout and shown in your order total before you pay.
We try hard to price everything correctly, but errors happen. If an item is listed at an obviously incorrect price and you order it, we may cancel the order and refund you in full. We will email you before doing so. We will never charge you more than the price shown at the moment you paid.
We do not display a struck-through "compare at" price unless the item was genuinely offered at that price recently.
4. How a contract is formed
Adding an item to your cart is not an order. Completing checkout is an offer to buy. Our order confirmation email acknowledges receipt but does not form a contract. The contract forms when we send the shipping confirmation email for that item.
Until that point we may decline or cancel an order — for example if the item cannot be produced, if the price was wrong, or if we suspect fraudulent use of a payment method. If we cancel, we refund you in full.
5. Payment
Payment is taken at checkout. See our Payment Policy for accepted methods, what appears on your card statement, and how authorization holds work.
6. Shipping and returns
Delivery times, cut-offs and shipping charges are set out in our Shipping Policy. Return rights, timeframes and the return address are set out in our Refund & Returns Policy. Both are incorporated into these terms.
7. Intellectual property
All designs, artwork, photographs, text and layout on this site are owned by ELSEN FULFILLMENT LLC or used under license. You may not reproduce, redistribute, or use them commercially without written permission. Buying a printed item gives you ownership of that item, not of the design on it.
8. Copyright complaints (DMCA)
If you believe material on this site infringes your copyright, send a notice to support@customifytee.com including: identification of the work, identification of the material you say infringes it and where it sits on the site, your contact details, a statement that you believe in good faith the use is unauthorized, a statement under penalty of perjury that your notice is accurate and you are authorized to act, and your physical or electronic signature.
We remove material that is the subject of a valid notice and will notify the affected party, who may submit a counter-notice.
9. Customer reviews
If we publish customer reviews, they will be genuine reviews from verified purchasers. We do not write reviews ourselves, we do not buy them, we do not import them from marketplaces, and we do not offer discounts or free product in exchange for a positive review. We do not delete a review because it is negative. We may remove a review that is abusive, off-topic, or contains personal information.
This reflects our obligations under the FTC's Rule on the Use of Consumer Reviews and Testimonials.
10. Acceptable use
Do not use this site to break the law, to attempt to gain unauthorized access to it, to scrape it at a rate that degrades it for other people, or to submit content that is unlawful, threatening, or infringing. We may refuse service to anyone who does.
11. Disclaimers and limitation of liability
The site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, our total liability arising out of or relating to any order is limited to the amount you paid for that order.
We are not liable for indirect, incidental, special or consequential damages. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or for death or personal injury caused by negligence.
Some states do not allow the exclusion or limitation of certain damages. If you live in such a state, some of the above may not apply to you, and you may have additional rights.
12. Governing law and how disputes are resolved
These terms are governed by the laws of the State of Montana, United States, without regard to its conflict of law rules.
We would much rather sort a problem out by email than in front of a judge, so please contact us first — most disputes are resolved within a day or two.
If that does not work, you may bring a claim in the state or federal courts located in Montana, or in the courts of the state where you live, whichever you prefer. You may also bring an individual claim in small claims court in your own county if it qualifies there.
Your rights as a consumer are not affected by this section. Nothing here requires you to waive a right you hold under the law of your state, and nothing here limits the authority of the Federal Trade Commission or your state Attorney General to act on your behalf.
13. Changes to these terms
We may update these terms. The version that applies to your order is the version published at the moment you placed it. Material changes will be reflected in the effective date at the top of this page.
14. Severability
If any part of these terms is found unenforceable, the rest continues to apply.
